Regulation? We don’t need no stinkin’ regulation!

For quite some time, conservatives and smallgovernment
advocates have derided government in
general, and government regulation and oversight
specifically, as an evil that must be purged if America
is to survive and prosper in today’s highly competitive
global market. Experts from Allan Greenspan to Phil
Gramm to Grover Norquist have beseeched us to free
our corporations and economy of the stifling effects of
regulation. The Bush Administration certainly drank
the Kool-Aid, as witnessed by eight years of rampant
deregulation and the manipulation of regulatory agencies.
Bush grew infamous for appointing former
industry leaders to regulatory positions in the industries
they once worked. Sometimes choices were purely
political in nature. Probably the most notable—and
disastrous--was Michael Brown to be Undersecretary of
Emergency Preparedness and Response. Brown simply
was not qualified. His incompetence in the aftermath
of Katrina is memorable, as is the famous Bush line,
“Brownie, you’re doing a heck of a job.” The escapade
was fodder for late-night comedians, but the sad fact
is that many poor people in New Orleans lost their
homes and, in some cases, their lives, thanks to the poor
response from FEMA.
Two recent events have shown just what a lack
of government regulation and oversight can produce: The
global financial crisis of 2008, and the environmental
disaster in Harriman, where a 40-acre coal-waste holding
pond at the TVA Kingston power plant collapsed,
releasing over a billion gallons of toxic waste into the
confluence of the Emory and Clinch rivers and destroying
several homes nearby.
There are multiple reasons for the financial crisis
the entire world is now trying to cope with, among them
lax or incompetent regulatory oversight, the elimination
of previous laws designed to protect the public from
unscrupulous mortgage lenders and greedy corporate
CEO’S, and investors who asked no questions about
financial instruments they didn’t understand so long as
they got stellar returns on their investments.
Investment banks packed lots of mortgage loans
into Collateralized Debt Obligations (CDO’s) and sold
them as securities on Wall Street. The revenue
returns from the interest payments were significant,
and these instruments became very popular
worldwide. But these innovations were largely
unregulated and no one seemed to consider what
might happen if a large number of mortgages loans
defaulted. When one acknowledges that many of
these mortgages were made to unqualified applicants
by predatory lenders, it’s clear that these CDO’s
were a time bomb. Where were the regulators?
The Securities and Exchange Commission
failed to raise red flags in 1992 after three small
firms associated with Bernard Madoff were
sanctioned for illegally raising money for Madoff.
Madoff was recently arrested for running what he
himself described as a massive Ponzi scheme, in
which not only many wealthy investors lost millions,
but many charities that invested in his hedge funds
did, as well. Clearly, the SEC failed abysmally in
this case, seeing as how it had information it should
have followed up on. Could one reason have to do
with the fact the SEC is significantly understaffed?
In the case of the Harriman disaster, the
chief problem is not with regulatory agencies
but with plain lack of regulation. For years,
environmental groups have tried to get the waste
from coal-burning power plants regulated, without
success, thanks to intense lobbying from the
industry. TVA knew it had problems with the
Harriman holding pond but rejected recommended
solutions out to financial concerns. Now, the cost of
dealing with the disaster will be many times more
that what the solutions would have cost.
The lesson to be learned here is that
regulations and regulatory agencies exist for a
reason. That reason is the protection and well being
of the public. Be it in regard to clean water and air,
food, pharmaceuticals, toys, or a multitude of other
products and services, government regulation has
a purpose. Yes, too much regulation can be stifling
and a drain on the economy, but too little can have
disastrous consequences. ■

JOKE OF THE MONTH
A Really Bad Day

There was this guy at a bar, just looking at his drink. He stays like that for half of an hour.

Then, this big trouble-making truck driver steps next to him, takes the drink from the guy, and just drinks it all down. The poor man starts crying. The truck driver says, "Come on man, I was just joking. Here, I'll buy you another drink. I just can't stand to see a man cry."

"No, it's not that. This day is the worst of my life. First, I fall asleep, and I go late to my office. My boss, outrageous, fires me. When I leave the building, to my car, I found out it was stolen. The police said that they can do nothing. I get a cab to return home, and when I leave it, I remember I left my wallet and credit cards there. The cab driver just drives away."

"I go home, and when I get there, I find my wife in bed with the gardener. I leave home, and come to this bar. And just when I was thinking about putting an end to my life, you show up and drink my poison."
